Refund, Cancellation & Limited Liability Policy

This Refund, Cancellation & Limited Liability Policy (“Policy”) applies to all purchases made from Fit & Fuel 365, including:

  1. In-Person Training Sessions

  2. Online Coaching Packages (Fitness / Nutrition / Combined)

  3. Clothing & Merchandise

By purchasing any product or service from Fit & Fuel 365, you acknowledge that you have read, understood, and agree to the terms of this Policy.

 

1. Definitions

For the purposes of this Policy:

“Client”, “You”, or “Your” refers to the individual purchasing products or services from Fit & Fuel 365.

“In-Person Sessions” refers to any one-on-one or small-group training sessions conducted physically in a gym or other agreed location.

“Online Packages” refers to fitness, nutrition, or combined coaching services delivered remotely (e.g., through email, applications, online platforms, documents, or PDFs) and billed monthly.

“Plan” refers to any customized fitness program, workout routine, meal plan, nutrition guidance, or coaching materials provided as part of an Online Package.

“Clothing” or “Merchandise” refers to any apparel or branded merchandise sold by Fit & Fuel 365.

“Business Day” means Monday through Friday excluding statutory holidays in Ontario, Canada.

All time references are based on Eastern Time (ET).

 

2. In-Person Training Sessions

2.1 Refund Eligibility

Completed Sessions

Any In-Person Session that has already taken place is strictly non-refundable.

Cancellations With 24+ Hours Notice

If you cancel a scheduled session at least 24 hours prior to the start time, you may choose one of the following:

  • A full refund for that session, or

  • A credit toward a future session to be used within 90 days, unless otherwise agreed in writing.

Cancellations Within 24 Hours

If you cancel less than 24 hours before the session, the following applies:

  • A $25 CAD cancellation fee will be applied.

If the session was prepaid:

Refund = session price minus $25 CAD

If the session was not prepaid:

You authorize Fit & Fuel 365 to charge or invoice you for the $25 cancellation fee.

No-Show Policy

If you fail to attend a scheduled session without notice (“no-show”), the session is forfeited in full and no refund or credit will be issued.

 

2.2 Session Expiration

Unless otherwise agreed in writing:

Prepaid sessions or session packages must be used within six (6) months of purchase. Any unused sessions after this time may expire and become non-redeemable.

 

2.3 How to Cancel a Session

Session cancellations must be submitted through written communication, including:

  • Email

  • Text message

  • Approved messaging platform used with your trainer

The timestamp of our system will determine whether the 24-hour cancellation window has been met.

 

3. Online Coaching Packages (Fitness & Nutrition)

Online coaching packages are billed monthly and renew automatically unless cancelled according to this Policy.

 

3.1 Ontario 10-Day Cooling-Off Period

In accordance with Ontario consumer protection principles, clients may cancel an Online Package within ten (10) days of the Start Date.

Written notice must be submitted to:

If cancellation occurs within this period, refunds may be issued subject to services already delivered, as described below.

 

3.2 Charges for Services Already Delivered

If your customized training program, nutrition plan, or coaching materials have already been delivered, you will be responsible for a pro-rated daily service fee.

Daily Rate Calculation

Daily Rate = Monthly Package Price ÷ 30

Amount Owed

Amount Owed = Daily Rate × Number of Days Used

“Days Used” is calculated from the date the plan is delivered to you until the date we receive written cancellation.

Example

Monthly price: $99.00 CAD
Daily rate: $99 ÷ 30 = $3.30/day

If your plan was delivered on the 1st and you cancel on the 5th:

5 days × $3.30 = $16.50 non-refundable

The remaining balance will be refunded.

 

3.3 Refund Processing

Approved refunds will be issued:

  • Using the original payment method where possible, or

  • By Interac e-Transfer (EMT) at our discretion.

Refunds are typically processed within 7 business days after confirmation of the refund amount.

Financial institutions may require additional processing time.

 

3.4 After the 10-Day Cooling-Off Period

After the cooling-off period has passed:

  • The Online Package continues on a month-to-month basis.

  • No refunds are provided for the current billing month, except where required by law or approved at our sole discretion.

 

3.5 Cancelling Future Renewals

To prevent automatic renewal, written notice must be provided at least 48 hours before your next billing date.

If notice is received less than 48 hours before renewal:

Your subscription may automatically renew.

If cancellation occurs after renewal, the pro-rated daily formula described above will apply to determine the non-refundable portion of that billing period.

 

3.6 Access to Coaching Materials After Cancellation

Upon cancellation:

  • Access to coaching platforms, communication channels, or shared resources may be revoked.

  • You may retain copies of plans provided for personal use only.

You may not copy, resell, share, or distribute Fit & Fuel 365 coaching materials.

All coaching programs, meal plans, and training materials remain the intellectual property of Fit & Fuel 365.

 

4. Clothing & Merchandise

4.1 Manufacturer Defects

If your clothing item arrives with a manufacturing defect:

You must notify us within five (5) business days of delivery.

Send an email to:

info@fitandfuel365.com

Include:

  • Photos clearly showing the defect

  • Order number or invoice

  • Description of the issue

If we determine the issue is a legitimate manufacturing defect, we may provide:

  • A replacement item, or

  • A refund or store credit at our discretion.

Replacement items may be subject to shipping fees unless otherwise required by law.

 

4.2 Exchanges (Size or Preference)

Clothing may be exchanged if:

  • The item is unworn, unwashed, and undamaged

  • Tags and original packaging are intact

Requests must typically be made within 30 days of delivery.

Customers are responsible for shipping costs for exchanges unless otherwise stated.

 

4.3 Non-Returnable Items

Returns or exchanges may be refused for items that are:

  • Worn, washed, stained, or altered

  • Carry strong odors (smoke, perfume, deodorant, etc.)

  • Marked FINAL SALE

 

5. Chargebacks & Payment Disputes

Clients agree to contact Fit & Fuel 365 before initiating a chargeback with their bank or credit card provider.

Initiating a chargeback without first attempting to resolve the issue with us may be considered a breach of this Policy.

We reserve the right to provide documentation of this Policy and transaction records in response to any payment dispute.

 

6. Assumption of Risk & Health Responsibility

Participation in fitness and nutrition programs involves inherent risks including injury, illness, or aggravation of existing conditions.

By purchasing or participating in any service:

  • You acknowledge that physical exercise involves risk.

  • You agree to participate voluntarily and at your own risk.

  • You confirm that you are responsible for consulting a qualified healthcare professional before beginning any exercise or nutrition program.

Fit & Fuel 365 programs are not medical advice and do not replace professional medical consultation.

 

7. Limitation of Liability

To the fullest extent permitted by law:

  • Fit & Fuel 365 does not guarantee specific fitness, health, or nutrition results.

  • Individual outcomes vary.

Our total liability for any claim relating to products or services will not exceed the amount you paid for that specific product or service.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of income, profits, or opportunities.

 

8. Third-Party Services

We may use third-party platforms including:

  • Payment processors

  • Communication platforms

  • Coaching software or apps

Fit & Fuel 365 is not responsible for outages, security breaches, or technical issues caused by third-party providers.

 

9. Force Majeure

Fit & Fuel 365 is not responsible for delays or inability to provide services due to events beyond our control, including:

  • Illness or injury

  • Severe weather

  • Power outages

  • Government restrictions

  • Facility closures

Where possible, we will make reasonable efforts to reschedule services or provide alternatives.

 

10. Right to Refuse or Terminate Service

Fit & Fuel 365 reserves the right to refuse or terminate services to any client engaging in:

  • Harassment or abusive conduct

  • Unsafe or inappropriate behavior

  • Repeated violation of scheduling or payment policies

Refunds in such situations are issued at our sole discretion.

 

11. How to Request a Refund, Exchange, or Cancellation

For clothing defects, please include clear photos of the issue.

 

12. Policy Updates

Fit & Fuel 365 may update this Policy periodically.

Updates will be posted on our website with a revised “Last Updated” date.

Continued use of our services or purchases after updates are posted constitutes acceptance of the revised Policy.
