This Refund, Cancellation & Limited Liability Policy (“Policy”) applies to all purchases made from Fit & Fuel 365, including:
In-Person Training Sessions
Online Coaching Packages (Fitness / Nutrition / Combined)
Clothing & Merchandise
By purchasing any product or service, you acknowledge that you have read, understood, and agree to this Policy.
1. Definitions
For the purposes of this Policy:
“We”, “Us”, “Our” – 14297849 Canada Inc. O/A Fit & Fuel 365.
“Client”, “You”, “Your” – The individual purchasing products or services.
“In-Person Sessions” – Any one-on-one or small-group training sessions delivered physically at a gym or in person.
“Online Packages” – Any fitness, nutrition, or combined coaching plan delivered remotely (e.g., via email, app, PDF or other online platform) and billed monthly.
“Plan” – The specific training and/or meal plan created for you as part of an Online Package.
“Clothing” – Any apparel or merchandise (e.g., hoodies, T-shirts, sweaters) sold by Fit & Fuel 365.
“Business Day” – Monday to Friday, excluding statutory holidays in Ontario.
All times are based on Eastern Time (ET).
2. In-Person Training Sessions
2.1 Refund Eligibility
Sessions already completed
Any In-Person Session that has already taken place is strictly non-refundable.
Sessions not yet taken – 24+ hours’ notice
If you cancel a scheduled In-Person Session at least 24 hours before the start time, you may choose:
A full refund for that session, or
A credit toward a future session, to be used within 90 days (unless otherwise agreed in writing).
Sessions cancelled within 24 hours of appointment
If you cancel a scheduled In-Person Session with less than 24 hours’ notice, the following applies:
A $25.00 CAD cancellation fee is applied per cancelled session.
If you have prepaid for the session, the refund amount will be the session price minus $25.00 CAD.
If the session was not prepaid, you authorize us to charge or invoice the $25.00 CAD cancellation fee.
No-Show Policy
If you fail to attend a scheduled session without any notice (“no-show”), the session is forfeited in full and no refund or credit will be issued.
2.2 How to Cancel an In-Person Session
To cancel, you must provide notice via email, text message, or other written method approved by your trainer. The timestamp on our system (email inbox, messaging app, etc.) will determine whether the 24-hour requirement has been met.
3. Online Coaching Packages (Fitness & Nutrition)
Our Online Packages are billed monthly and renew automatically unless cancelled in accordance with this Policy.
3.1 10-Day Cooling-Off Period (Ontario)
You have a 10-day cooling-off period from the date you enter into an Online Package agreement (“Start Date”).
During this 10-day period, you may cancel the agreement for any reason by providing written notice (email is sufficient) to Fit & Fuel 365.
However, if we have already delivered your meal plan and/or fitness routine during this period, we reserve the right to retain payment for services already rendered, as outlined below.
3.2 Charges for Services Already Delivered (Pro-Rated Formula)
Once your individualized meal plan and/or fitness routine has been shared with you, you will be responsible for paying a pro-rated daily amount for each day the plan has been available to you.
Daily Rate Formula:

Amount Owed for Used Days:

Number of Days Used is counted from the date the plan is first delivered to you up to and including the date we receive your written cancellation notice.
Example (your example, reframed):
Monthly price: $99.00 CAD
Daily Rate: $99 ÷ 30 = $3.30/day
Plan delivered on the 1st; cancellation received on the 5th → 5 days used
Amount Owed: $3.30 × 5 = $16.50 CAD (non-refundable)
If you cancel within the 10-day cooling-off period but after receiving your plan, we will:
Calculate the non-refundable portion using the formula above.
Refund the remaining balance of your monthly fee.
Issue the refund by Interac e-Transfer (EMT) within 7 business days of confirming your cancellation and refund amount.
3.3 After the 10-Day Cooling-Off Period
Once the 10-day cooling-off period has passed:
Your Online Package continues on a month-to-month basis.
No refunds are provided for the current billing month after the 10th day, except as we may decide at our sole discretion or where required by law.
You may still cancel future renewals as set out in Section 3.4.
3.4 Cancelling Future Monthly Renewals (Online Packages)
To prevent renewal for the next month, you must provide written notice of cancellation at least 48 hours before your next billing date (“Renewal Date”).
If we do not receive written notice at least 48 hours prior to the Renewal Date:
Your plan will automatically renew for the next month.
If you choose to cancel after renewal has already occurred, we will apply the daily pro-rated formula described in Section 3.2 for each day into the new billing period up to the date we receive written cancellation.
The used portion (days used × daily rate) is non-refundable. Any unused portion may be refunded at our discretion or applied as a credit.

3.5 Access to Content After Cancellation
Once cancellation is effective, we reserve the right to revoke access to any private coaching platforms, documents, or resources associated with your plan.
You may retain copies of any meal plans or training routines provided for your personal use, but you may not share, resell, or redistribute them.
4. Clothing & Merchandise
4.1 Manufacturer Defects
We stand behind the quality of our apparel. If your clothing item arrives with a manufacturer defect, the following applies:
You must notify us within 5 business days of receiving the product.
Email clear photos of the defect along with your invoice number and order details to:
info@fitandfuel365.comIf we determine, in our reasonable discretion, that the issue is a genuine manufacturer defect (e.g., faulty stitching, printing error, significant material flaw not caused by wear or misuse), we will:
Offer a replacement of the same item (size and color subject to availability), or
If replacement is not available, offer a store credit or refund for the purchase price (at our discretion).
Shipping for replacement items:
Replacement may be subject to shipping costs, which may be charged to you unless otherwise required by law or agreed in writing.
4.2 Exchanges (Size / Color / Preference)
We are happy to exchange clothing if:
The item is unworn, unwashed, odor-free, and undamaged, and
All original tags and packaging are intact.
Additional exchange terms:
You may request an exchange if:
You ordered the wrong size,
You would like a different color, or
You simply do not like how the product looks or fits.
Clothing must generally be returned within a reasonable period after purchase (e.g., 30 days), unless otherwise stated on your receipt or product page.
Shipping costs for sending the item back to us and for shipping the replacement item to you are your responsibility, unless otherwise required by law or expressly covered by a promotion.
4.3 Non-Returnable Clothing
For hygiene and quality-control reasons, we reserve the right to refuse returns or exchanges for:
Items that appear worn, washed, stained, damaged, or altered.
Items smelling of smoke, perfume, deodorant, or other strong odors.
Clearance or final-sale items clearly marked “FINAL SALE – NO RETURNS OR EXCHANGES” at the time of purchase (except where defective under consumer protection laws).
5. Limited Liability
To the fullest extent permitted by applicable law:
No Guarantee of Results
Fitness and nutrition results vary between individuals.
We do not guarantee specific outcomes, such as weight loss, muscle gain, performance improvements, or health changes.
Health & Medical Responsibility
Our services and plans are not medical advice and are not a substitute for consultation with a physician or other healthcare professional.
You are solely responsible for consulting with your doctor before beginning any fitness or nutrition program, especially if you have pre-existing health conditions, injuries, or are pregnant/postpartum.
You agree to participate at your own risk.
Limitation of Damages
Our total liability to you for any claim arising out of or relating to any product or service (including In-Person Sessions, Online Packages, or Clothing) is limited to the amount you actually paid to us for that specific product or service.
Under no circumstances will we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of profits, or pain and suffering, even if advised of the possibility of such damages.
Third-Party Services & Platforms
We may use third-party platforms (e.g., apps, payment processors, messaging tools).
We are not responsible for outages, errors, or data breaches caused by those third-party providers, though we will make reasonable efforts to support you in resolving issues.
Force Majeure
We are not liable for delays, cancellations, or failures to perform due to causes beyond our reasonable control, including but not limited to illness, accidents, extreme weather, power outages, or government restrictions. In such cases, we will make reasonable efforts to reschedule or provide fair alternatives.

7. Changes to This Policy
We may update this Policy from time to time. Any changes will be posted on our website with an updated “Last Updated” date. Continued use of our services or purchase of our products after changes are posted constitutes acceptance of the revised Policy.
